Terms of Service

1. Agreement to Terms
By accessing or using Dublyo ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Dublyo is a Platform as a Service (PaaS) that enables users to deploy applications from GitHub repositories to Hetzner Cloud infrastructure. The Service includes:
- Server provisioning and management on Hetzner Cloud
- Docker container deployment and orchestration
- AI-powered Dockerfile generation
- SSL certificate management via Cloudflare
- Domain management and DNS configuration
- Pre-configured application templates
- Monitoring and logging tools
Application templates are provided as a convenience to help you deploy popular open-source and third-party software. Templates consist of Docker Compose configuration files that reference publicly available container images from their respective publishers (e.g., Docker Hub, GitHub Container Registry). Dublyo does not modify, compile, package, or distribute the underlying software — images are pulled directly from upstream sources by your server at deployment time.
3. User Accounts
3.1 Account Creation
To use the Service, you must create an account by authenticating with your GitHub account. You are responsible for maintaining the security of your account and any activities that occur under your account.
3.2 Account Requirements
- You must be at least 16 years old to use the Service
- You must provide accurate and complete information
- You may not use the Service for any illegal purposes
- You may not share your account credentials with others
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. You may terminate your account at any time through your account settings.
4. Billing and Payments
4.1 Credit System
Dublyo uses a credit-based billing system. 1 credit equals $0.01 USD. Credits are deducted hourly based on your running servers according to the current pricing schedule.
4.2 Payments
- Credits are purchased through PayPal
- All payments are non-refundable except as required by law
- Credits do not expire
- Prices are subject to change with notice
4.3 Insufficient Credits
If your account has insufficient credits, your servers may be suspended or terminated. We will make reasonable efforts to notify you before taking such action.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Distribute malware, viruses, or harmful code
- Conduct phishing, spamming, or fraudulent activities
- Mine cryptocurrency without explicit permission
- Host illegal content including child exploitation material
- Conduct DDoS attacks or other network abuse
- Attempt to gain unauthorized access to systems
- Resell the Service without authorization
- Interfere with or disrupt the Service or servers
Violation of these terms may result in immediate account termination without refund.
6. Content and Data
6.1 Your Content
You retain ownership of any code, data, or content you deploy through the Service ("Your Content"). By using the Service, you grant us a limited license to host and run Your Content as necessary to provide the Service.
6.2 Your Responsibilities
- You are responsible for backing up Your Content
- You are responsible for ensuring Your Content complies with applicable laws
- You are responsible for securing any sensitive data in Your Content
6.3 Data Deletion
When you terminate your account or delete a server, Your Content will be permanently deleted. We are not responsible for any loss of data.
7. Third-Party Services
The Service integrates with third-party services including GitHub, Hetzner Cloud, Cloudflare, and PayPal. Your use of these services is subject to their respective terms of service and privacy policies.
We are not responsible for the availability, security, or performance of third-party services.
8. Third-Party and Open-Source Software
8.1 Nature of Templates
When you deploy an application using a Dublyo template, you are directing your server to download and run third-party software from its original publisher. Dublyo acts solely as a hosting infrastructure provider and does not distribute, sublicense, or provide the third-party software itself. Your relationship with the third-party software is governed by its own license terms, not by this Agreement.
8.2 License Compliance
Each application available through our templates is governed by its own open-source or proprietary license (e.g., MIT, Apache 2.0, GPL, AGPL, BSL). You are solely responsible for reviewing and complying with the license terms of any software you deploy through the Service. Dublyo does not grant you any rights to third-party software beyond what is provided by the software's original license.
8.3 AGPL and Network-Copyleft Software
Some applications available through our templates are licensed under the GNU Affero General Public License (AGPL) or similar network-copyleft licenses. These licenses may require you to make source code available to users who interact with the software over a network. As the operator of the deployed instance, you — not Dublyo — are responsible for fulfilling any such obligations.
8.4 No Warranty for Third-Party Software
Dublyo makes no representations or warranties regarding the functionality, security, legality, or fitness for purpose of any third-party software deployed through our templates. Third-party software is provided by its respective publishers and is subject to their own terms, support policies, and update schedules. Dublyo is not responsible for any bugs, vulnerabilities, data loss, or other issues arising from the use of third-party software.
8.5 Intellectual Property of Third Parties
All trademarks, logos, and names of third-party applications displayed on our platform belong to their respective owners. Their display on Dublyo does not imply endorsement, sponsorship, or affiliation. If you believe any content on our platform infringes your intellectual property rights, please contact us at legal@dublyo.com.
9. Service Availability
9.1 Uptime
We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control.
9.2 Support
Support is provided via email on a best-effort basis. We do not guarantee response times.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUBLYO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
12. Indemnification
You agree to indemnify, defend, and hold harmless Dublyo and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.
13. Intellectual Property
The Service and its original content (excluding Your Content) are and will remain the exclusive property of Dublyo. The Service is protected by copyright, trademark, and other laws.
Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date.
Your continued use of the Service after any changes constitutes acceptance of the new Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the European Union, without regard to its conflict of law provisions.
Any disputes arising from these Terms shall be resolved in the courts of the European Union.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dublyo regarding the Service and supersede all prior agreements.
